2. Client and Candidate Obligations

Clients are responsible for providing clear job descriptions, expected deliverables, required timelines, and compensation details before the recruitment process begins. Clients must adhere to fair labor practices, confidentiality terms, and any additional contractual obligations outlined in service agreements. Candidates, on the other hand, are responsible for submitting accurate resumes, completing assessments or interviews, and fulfilling the terms of any contract or assignment agreed upon with the client. Both parties agree to maintain open and professional communication and notify Horizon Tech of any changes in project scope, expectations, or concerns.

3. Account Security

If you create an account with Horizon Tech for dashboard access, recruitment tracking, or communication purposes, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately if you suspect unauthorized access or a security breach. Horizon Tech is not liable for any loss or damage resulting from your failure to protect your credentials or unauthorized activity within your account.

4. Fees, Payments, and Refunds

Fees for our services are determined based on the specific scope of work and are communicated clearly before the project begins. Clients may be charged a one-time placement fee, monthly subscription, or retainer depending on the agreement. Payment timelines and methods are defined within service contracts. Horizon Tech reserves the right to suspend services for non-payment or delayed payments. Any refund requests must be submitted in writing and will be evaluated on a case-by-case basis according to the agreed service terms. Horizon Tech is not obligated to provide a refund unless explicitly stated in the agreement.

5. Intellectual Property

Unless otherwise agreed in writing, all original content, documentation, visual material, or software created by candidates or Horizon Tech during an assignment belongs to the client upon full payment. The Horizon Tech website, logo, brand materials, and internal systems are the intellectual property of Horizon Tech and may not be copied, distributed, or modified without prior written permission. Users may not use any of our trademarks or proprietary materials without authorization.

6. Confidentiality

Both clients and candidates agree to maintain the confidentiality of any non-public information shared during the course of their engagement. This includes business processes, client data, financial records, hiring needs, and candidate details. Horizon Tech ensures that all internal staff and third-party vendors follow strict confidentiality policies. Any breach of this clause may result in legal action and termination of access to services.

7. Service Limitations and Disclaimers

While Horizon Tech strives to deliver high-quality, reliable services, we cannot guarantee uninterrupted access to our platform or flawless performance in all circumstances. We do not guarantee the hiring success rate, performance of hired professionals, or business outcomes resulting from our services. Users understand that results may vary depending on multiple external factors, including candidate availability, client responsiveness, and market conditions. All services are provided “as is” without any warranties, express or implied.

8. Limitation of Liability

To the maximum extent permitted by law, Horizon Tech shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services. This includes, but is not limited to, loss of revenue, profits, data, or opportunities. Horizon Tech’s total liability under any service agreement will not exceed the amount paid by the client within the 30 days preceding the claim. We are not liable for any damages caused by third-party vendors, client systems, or candidate negligence.

9. Termination of Services

Either party may terminate a service agreement by providing written notice within the notice period defined in the contract. Horizon Tech reserves the right to suspend or terminate user access immediately if we suspect fraudulent activity, breach of contract, or abuse of our services. Upon termination, all pending payments must be cleared and all confidential data must be returned or destroyed as instructed. Candidates who are disengaged must complete final tasks and handovers professionally.

10. Dispute Resolution and Governing Law

In the event of a dispute between Horizon Tech and a user (either client or candidate), both parties agree to attempt resolution through mutual discussion and negotiation. If no resolution is reached, the matter will be referred to binding arbitration under Pakistani law. These terms are governed by the laws of Pakistan, and any legal proceedings will fall under the jurisdiction of the courts in Karachi, Sindh.

11. Changes to Terms

Horizon Tech reserves the right to modify these terms at any time to reflect changes in our services, operational policies, or legal requirements. Updates will be published on our website with the revised effective date. Continued use of our website or services after such updates constitutes your agreement to the updated terms.
